Spark & Stay Vacation Rental Agreement
By confirming your booking, you ("Guest") agree to the following legally binding terms with Spark &
Stay ("Host").
This agreement governs your stay at the privately-owned vacation rental property managed by
Spark & Stay in the State of Hawaii ("the Property").
It protects the safety, privacy, and integrity of the home, its environment, and all persons involved.
1. Acceptance of Terms
By completing a booking via Spark & Stay's direct site or any authorized channel, Guest affirms they
have read, understood, and accepted this Agreement in full.
2. Occupancy & Guest Verification
- Guest must declare all individuals staying on the Property prior to check-in, including children.
- A valid government-issued photo ID is required for all adult guests and must be submitted no later
than 48 hours before check-in.
- The Host reserves the right to deny check-in to undeclared or unidentified guests without refund.
- No additional, unregistered, or unapproved guests or visitors are allowed on the Property at any
time.
3. No Parties or Unauthorized Gatherings
- No parties, events, or large gatherings are allowed without the Host's prior written approval.
- Any unauthorized gathering will result in immediate eviction, loss of payment, and damage charges
as applicable.
4. Use of Property & Amenities
- Use of all amenities, including fire pits, paddle boards, decks, and ponds, is at the Guest's own
risk.
- Children must be supervised at all times, especially around decks, water features, and equipment.
- No smoking indoors. No illegal activity is allowed on the Property.
5. Guest Responsibilities
- Guest is responsible for their own safety and the behavior of their entire group.
- Guest agrees to return the Property in clean, respectful condition:
- All dishes must be rinsed or cleaned before departure.
- Trash must be disposed of in designated bins.
- All used equipment must be returned to its original place.
- If the Property is left in excessively dirty condition, including unwashed dishes or food waste, the
Guest will be charged an additional cleaning fee at the Host's discretion.
6. Damage, Liability & Charges
- Guest is financially responsible for any damage, theft, or misuse caused during their stay, including
actions by other members of their party.
- Host reserves the right to withhold or charge additional fees after checkout to cover any damages
or extra cleaning required.
- The Host is not liable for personal injury, property loss, or weather-related disruption.
7. Indemnification
Guest agrees to indemnify and hold harmless Spark & Stay, its owners, agents, and employees
from all claims, liabilities, or losses related to their stay.
8. Access & Enforcement
To ensure the safety, well-being, and peaceful enjoyment of the Property, the Host, property
manager, or trusted team members may access the Property if necessary for maintenance,
inspections, emergencies, or to address behavior that may be causing disruption, discomfort, or
safety concerns for others.
While we always aim to respect your privacy, certain situations may require entry without prior notice
to protect the integrity of the space and those nearby.
Violations of this Agreement may result in immediate termination of the stay, eviction without refund,
and financial accountability for any damages or breaches.
9. Governing Law
This Agreement is governed by the laws of the State of Hawaii. Any disputes will be resolved in
Hawaii state courts.
10. Security Monitoring
For your safety and to protect the home, exterior security cameras and/or noise monitoring devices
may be in use. These do not infringe on indoor privacy.
11. Wildlife & Environment Disclosure
Due to the tropical location, occasional contact with insects or wildlife may occur. The Host
maintains pest control routines but cannot guarantee a completely pest-free environment.
12. Natural Events
Guest agrees that the Host is not liable for natural events or disasters (including storms, flooding,
earthquakes, or volcanic activity) that may impact travel or use of the Property.
13. Utility Outages
Temporary outages of water, electricity, internet, or other services may occur and are beyond the
Host's control. No refunds will be provided for such outages.
14. Age Requirement
The primary Guest booking must be at least 25 years old and present during the stay.
