Hamakua Sunrise Estate — Rental Agreement

This Rental Agreement (“Agreement”) is made between Spark & Stay (“Host”) and the undersigned Guest, and governs the rental of the privately-owned vacation property known as Hamakua Sunrise Estate (“Property”) in the State of Hawaiʻi.

By confirming a booking, the Guest agrees to these legally binding terms. This Agreement protects the safety, privacy, and integrity of the Property, its environment, and all persons involved.

1. Acceptance of Terms

By completing a booking via Spark & Stay’s direct website or any authorized channel, Guest affirms they have read, understood, and accepted this Agreement in full.

2. Occupancy & Guest Verification

Guest must declare all individuals staying at the Property prior to check-in, including children.
A valid government-issued photo ID is required for all adult guests and must be submitted no later than 48 hours before check-in.
The Host reserves the right to deny check-in to undeclared or unidentified guests without refund.
No unregistered or unapproved guests or visitors are allowed on the Property at any time.
Maximum occupancy is 20 guests.

3. No Parties or Unauthorized Gatherings

Parties, events, and large gatherings are not allowed without the Host’s prior written approval.
Weddings, retreats, or special events require a separate written contract and approval.
Unauthorized gatherings will result in immediate eviction, loss of all payments, and damage charges as applicable.

4. Use of Property & Amenities

Use of all amenities, including fire pits, paddle boards, decks, and ponds, is at the Guest’s own risk.
Children must be supervised at all times, especially near water features and equipment.
No smoking indoors. No illegal activity is allowed on the Property.
Pets are not allowed.

5. Guest Responsibilities

Guest is responsible for their own safety and the behavior of their entire group.
Guest agrees to return the Property in clean, respectful condition:
- All dishes must be rinsed or cleaned before departure.
- Trash must be disposed of in designated bins.
- All used equipment must be returned to its original place.
If the Property is left in excessively dirty condition, including unwashed dishes or food waste, the Guest will be charged an additional cleaning fee at the Host’s discretion.

6. Damage, Liability & Charges

Guest is financially responsible for any damage, theft, or misuse caused during their stay, including actions by other members of their party.
Host reserves the right to withhold or charge additional fees after checkout to cover any damages or extra cleaning required.
Late check-out is charged at $50 per hour unless otherwise arranged in writing.
The Host is not liable for personal injury, property loss, or weather-related disruption.

7. Payment & Cancellation Policy

Payment is due in full at the time of booking.
All bookings are non-refundable. Cancellations, no-shows, or changes in travel plans will not result in a refund.
At the discretion of the Host, a booking credit may be applied toward future stays, but refunds are not guaranteed.

8. Indemnification

Guest agrees to indemnify and hold harmless Spark & Stay, its owners, agents, and employees from all claims, liabilities, or losses related to their stay.

9. Access & Enforcement

To ensure the safety, well-being, and peaceful enjoyment of the Property, the Host, property manager, or trusted team members may access the Property if necessary for maintenance, inspections, emergencies, or to address behavior that may be causing disruption or safety concerns.
While we respect guest privacy, certain situations may require entry without prior notice.
Violations of this Agreement may result in immediate termination of the stay, eviction without refund, and financial accountability for damages.

10. Governing Law

This Agreement is governed by the laws of the State of Hawaiʻi. Any disputes will be resolved in Hawaiʻi state courts.

11. Security Monitoring

For guest safety and protection of the home, exterior security cameras and/or noise monitoring devices may be in use. These do not infringe on indoor privacy.

12. Wildlife & Environment Disclosure

Due to the tropical location, occasional contact with insects or wildlife may occur. The Host maintains pest control routines but cannot guarantee a completely pest-free environment.

13. Natural Events

Guest agrees that the Host is not liable for natural events or disasters (including storms, flooding, earthquakes, or volcanic activity) that may impact travel or use of the Property.

14. Utility Outages

Temporary outages of water, electricity, internet, or other services may occur and are beyond the Host’s control. No refunds will be provided for such outages.

15. Age Requirement

The primary Guest booking must be at least 25 years old and present during the stay.

By confirming your booking, you accept all terms of this Rental Agreement.
